يجمع كتاب الإمام ابوبكر بن العربي ذخيرة وافية من القواعد الأصولية التي يتردد ذكرها بين ثنايا شرحه للمسائل الفقهية باعتبارها الأصل الذي بنى عليه تلك الفروع، وفي حال استقراء تلك القواعد والاختيارات الأصولية وحدث أن الأمر يحتاج إلي بحث أطول وزمن أكبر، لذا اختصرت هذه الورقة والحديث عن الأصول الثلاثة وهي الكتاب وما يتعلق به من حيث القراءة، مثلاً كالقراءة الشاذة وما يبنى عليها من فرع، وكذلك السنة من حيث السند، كالحديث المرسل وحجيته وما يمكن أن يبنى عليه وكذلك الإجماع وحجيته، وما يبنى عليه، كل ذلك بحسب ما ذكر في ثنايا الكتاب من عبارات أصولية وفروع فقهية، ثم ختمت بعدد من النتائج والتوصيات.
Abstract:
The book of Imam Abu Bakr Ibn Al-Arabi collects a sufficient repertoire of fundamentalist rules that are frequently mentioned in the course of his explanation of Fiqh issues as the origin on which he built those branches, and in the event that extrapolating those fundamentalist rules and choices and it happened that it needed longer research and more time, so this paper was shortened and talked about the three Origins, namely the book and it is based on it, all according to what was mentioned in the book of fundamentalist phrases and branches of jurisprudence, and then concluded with a number of findings and recommendations.
